Bonsai Kreativ - Studio terms & conditions

Provider and scope

These terms apply to purchases of goods from the studio where agreed before the contract is concluded. Workshops run by the legally separate Bonsai Kreativ association are subject to its own participation terms.

Inquiry and personal quotation

Product listings allow you to make a non-binding inquiry. Adding products to your cart and sending a shipping inquiry do not create a purchase contract, payment obligation or reservation. The automatic acknowledgment of receipt is not acceptance of an order either.

After availability and shipping have been checked, you will receive a personal quotation stating the goods, the total price including shipping, and the specific payment and delivery terms. The quotation explains how to accept it and when the contract is concluded. A contract is formed only through the subsequent agreement.

Prices, payment and delivery

All product prices are stated in euros. VAT exempt under section 6(1)(27) of the Austrian VAT Act (small business exemption).

Shipping costs are calculated individually based on size, weight, packaging requirements and destination and communicated before any binding agreement. Delivery availability, delivery period, payment method and payment due date are set out in the personal quotation. No payment is due as a result of the non-binding inquiry.

Withdrawal and returns

Consumers generally have a statutory right of withdrawal for distance contracts covered by that right. The time limit, procedure, consequences and statutory exceptions are explained in the separate withdrawal information. This information and the model withdrawal form are provided before you make a binding contractual declaration.

Statutory warranty and contact

Statutory warranty rights apply. They are unaffected by a right of withdrawal or any voluntarily agreed return. For questions, defects or complaints, please contact the studio using the details above.

Withdrawal & returns

This information concerns distance purchases of goods by consumers from the Josef Rauscher studio. The German terms Rücktritt and Widerruf refer to the same right of withdrawal. Separate participation terms apply to association workshops.

Your right of withdrawal

You may withdraw from the contract within 14 days without giving a reason. The period starts on the day you, or a person you nominate who is not the carrier, receive the goods. If several goods from a single order are delivered separately, the relevant date is receipt of the last item; for goods delivered in several parts, it is receipt of the last part.

State clearly that you wish to withdraw, for example by email or letter. You may use the model form below, but it is optional. Sending your notice before the deadline is sufficient.

Refunds and returns

Following your withdrawal, we will refund payments received, including the cost of our least expensive standard delivery option, without undue delay and no later than 14 days after receiving your notice. Additional costs for an expressly chosen, more expensive delivery method will not be refunded. We will use the same payment method unless another method of refund at no cost to you has been expressly agreed.

We may withhold the refund until the goods have been returned or you have provided proof of return, whichever is earlier. This does not apply if we have offered to collect the goods.

Send or hand the goods back to Josef Rauscher at the address above without undue delay and no later than 14 days after giving your withdrawal notice. Dispatch before the deadline is sufficient. If we have offered collection, you do not have to return the goods yourself.

You bear the direct return costs if you were informed of this before the contract was concluded. For goods that cannot normally be returned by post because of their nature, we will state the return costs or a permitted maximum estimate in the personal quotation. Without the required cost information, you do not have to bear these return costs.

You are liable for diminished value only where it results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, and where you were properly informed of your right of withdrawal.

Custom-made goods and rights concerning defects

The statutory right of withdrawal does not apply to goods made to customer specifications or clearly personalised. A finished unique piece offered for sale is not automatically excluded for that reason. Any applicable exception will be communicated before the contract is concluded.

Your statutory warranty rights remain in place. This information does not promise any additional voluntary right of return.
